Chef Satisfaction Essay

The findings showed that employees’ job satisfaction directly and positively influences organizational commitment, but does not directly influence job performance. Employees’ job satisfaction enhances job performance only through organizational commitment. Internal marketing, empowerment and leadership also positively influence job satisfaction. Empowerment and leadership enhance employees’ organizational commitment. Internal job stress negatively influences employees’ job satisfaction and external job stress enhances employees’ job performance. According to the findings, this paper realized the main factors which influence hospitality industry employees’ job satisfaction, organizational commitment and job performance, which can function as criteria for human resource management in the hospitality industry. Key words: Hospitality industry, job satisfaction, organizational commitment, job performance.   With the change of the industrial structure in recent years, the output value of the service industry has become more than 70% of the GDP in most advanced countries (CIA, 2009). Thus, the service industry plays a significant role in national economic development. In 2008, as the world encountered a financial tsunami, the governments of different countries selected potential service industries and supported them with resources, in order to energize economic development. The hospitality industry is a typical service industry, and it is critical service industry around the world. In Taiwan, the scale of the hospitality industry has been increasing year by year. According to the Statistics Department, Ministry of Economic Affairs, in 2001 the business volume of the hospitality industry in Taiwan was NTD 261. 3 billion. In 2006 it passed NTD 300 billion and in 2009 it reached NTD 321. 7 billion. However, the hospitality industry refers to labor services and relies on manpower in areas such as production, delivery and restaurant service. Thus, the hospitality industry is mainly based on services. As mentioned in Bitner’s (1995) framework of the service marketing triangle, service providers play a critical role in the service industries. In service industry management, regarding the importance of employees, Heskett et al. (1994) proposed the framework of service profit chain. Tsai et al. 4119 quality, employee satisfaction/productivity, the value of services provided to the customer, customer satisfaction and company’s profits. This chain shows that internal service quality can enhance employee satisfaction, which will enhance employee productivity and further result in external service value and enhanced customer satisfaction. Finally, the company can make a profit (Zeithaml et al. , 2009). Therefore, satisfied employees make satisfied customers. Service personnel satisfaction significantly influences organizational commitment and job performance on customer satisfaction and corporate operational performance (Ladkin, 2002; Dunlap et al. , 1988; Tansuhaj et al. , 1988; Chowdhary, 2003; Yang and Chen, 2010). How to enhance service personnel satisfaction, organizational commitment and job performance is a critical issue in service industry management. In past research on employee satisfaction, organizational commitment and job performance, many scholars (Babin and Boles, 1998; Bernhardt et al. 2000; Van Scotter, 2000; Koys, 2003; Testa, 2001) have validated that employees’ job satisfaction positively influences job performance and organizational commitment. In studies on factors of employees’ job satisfaction, job performance and organizational commitment, the service profit chain proposed by Heskett et al. (1994) and service marketing management model indica ted by Tansuhaj et al. (1988) on overall service industry both demonstrated that management’s internal marketing activities produce job satisfaction and commitment to the organization. In addition, many studies have found close relationships between leadership, employee satisfaction, organizational commitment and job performance (Billingsley and Cross, 1992; Yammarino and Dubinsky, 1994; Burton et al. , 2002; Avolio et al. , 2004; Chen and Silverthorne, 2005). The above studies have mainly focused on the educational service industry, retail industry, manufacturing service industry, medical service industry and governmental institutions, but have not conducted indepth explorations on the hospitality service industry. Hopfl (1994) indicated that in the service delivery, firstline employees must be empowered to some degree in order to cope with customers’ special demands. Thus, job empowerment can be treated as important management to encourage first-line service personnel and immediately solve customers’ differential demands. Avolio et al. (2004), Caykoylu et al. (2007) and Chen et al. (2008) respectively conducted empirical studies on medical personnel and employees of the telecommunication industry, banking industry and postal industry, and found that empowerment positively influences employee satisfaction and organizational commitment. One issue worthy of further study is the extent of how empowerment positively influences hospitality industry employee satisfaction and organizational commitment. In addition, first-line employees face different customer demands and supervisor requirements, therefore job stress is a critical issue for them. Jamal (1990) and Jex (1998) suggested that reducing employees’ job stress could enhance employees’ job satisfaction and job performance. Williams and Cooper (2002) and Ouyang (2009) indicated that proper job stress would enhance employees’ job performance. In the hospitality industry, the influence of job stress from external customers and internal supervisors on employees’ job satisfaction and job performance is an issue worthy of further exploration. Based on the above, internal marketing, leadership, empowerment and job stress are possible factors of service industry employees’ job satisfaction, organizational commitment and job performance, and these factors are validated in various service industries. However, the outcomes in different service industries are not the same. For the hospitality industry, it is important to validate and analyze the influences of the above factors on employees’ job satisfaction, organizational commitment and job performance. Thus, this study intended to combine internal marketing, leadership, empowerment and job stress and proposed an integrated model of hospitality industry employees’ job satisfaction, organizational commitment and job performance. Hospitality industry employees in Taipei City were treated as the subjects, and the researcher probed into factors of hospitality industry employees’ job satisfaction, organizational commitment and job performance in order to function as criteria for management in the hospitality industry. LITERATURE REVIEW Job satisfaction The term â€Å"job satisfaction† was proposed by Hoppock (1935) who suggested that job satisfaction means employees’ emotions and attitude toward their jobs, and is their subjective reaction toward their jobs. The definition of job satisfaction is generalized into three categories: (1) Definition of generality: Job satisfaction refers to the affective reaction to one’s job as the most (Ozer and Gunluk, 2010). Job satisfaction, which is one of the most important necessities for an individual to be successful, happy and productive, is a feeling of satisfaction, that is, an outcome of the perception of what the job provides for an individual (Ay and Av aro lu, 2010); (2) Definition of difference: This refers to the degree of satisfaction and the difference between ndividual actual returns and required returns. For instance, Porter and Lawler (1968) suggested that the degree of satisfaction depends on the difference between a person’s actual returns and expected returns; (3) Definition of criterion framework: Peoples’ subjective perception and interpretation on objective traits of organizations or jobs would be influenced by individual criterion framework. According to Smith et al. (1969), job satisfaction is the outcome after a person interprets the job traits according 4120 Afr. J. Bus. Manage. o the criterion framework. The influence of certain work situations on job satisfaction is related to many factors, such as comparisons between good and bad jobs, comparisons with others, personal competency and past experience, etc. Job performance Kane and Lawler (1976) suggested that job performance refers to the record of the results when employees have practiced a job for a certain period of time. According to Schermerhorn (1989), job performance refers to the quality and quantity accomplished by individuals or groups after fulfilling a task. After a certain period of time, measurements of employees’ job performance could serve as criterion for promotions, wage adjustments, rewards, punishments and evaluations. Cascio (2006) suggested that managers must specifically define performance to allow the teams or employees to recognize the organizational expectations in order to fulfill the organizational goals. In other words, managers must set concrete goals, trace the fulfillment degree and evaluate the teams’ or employees’ performance. Van Scotter and Motowidlo (1996) suggested that employees with a high degree of job enthusiasm will demonstrate extra effort and devotion, and will actively seek out solutions to problems at work in order to enhance their job performance. Robbins (1998) divided the measurement of job performance into job result, job behavior and personal traits. Lee et al. (1999) divided job performance into efficiency, efficacy and quality. Efficiency refers to the employees’ output rate and is the ability to accomplish tasks before deadline. Efficacy refers to the employees’ goal accomplishment rate and proposals. Quality refers to the employees’ error rate and complaint rate, supervisor satisfaction, customer satisfaction and colleague satisfaction. This study suggested that in the application of this construct to measure hospitality industry employees’ job performance, efficiency should refer to the employees’ speed in customer service, efficacy should mean the accomplishment of tasks assigned by customers, and quality should mean the employees’ performance in customer service. As to measurement, Shore and Thornton (1986) indicated that self-evaluation allows individuals to participate in performance evaluation and serves as a criterion. Based on the above, according to the views of Lee et al. (1999), this study divided job performance into efficiency, efficacy and quality, and measured hospitality industry employees’ job performance using employee self-evaluation. Smith et al. (1969) proposed the Job Description Index (JDI) to measure job satisfaction, with the constructs including wage, promotion, job, supervisors and colleagues. Black and Gregersen (1997) found a positive correlation between job satisfaction and job performance. Organ (1990) suggested that when employees are satisfied with their work, they are willing to sacrifice themselves and devote to their organization. Organizational commitment From the perspective of attitude, Porter et al. (1974) indicated that organizational commitment is a person’s active and positive intention to identify with and internalize organizational goals and value. According to Reyes and Pounder (1990), organizational commitment is the strong belief and intention to identify with organizational value, devote to and stay with the organization. Mathews and Shepherd (2002) suggested that organizational commitment refers to workers’ attitude, behavior and connection between individuals and the organization. Guest (1995) indicated that organizational commitment is at the core of human resource management. It transforms traditional manpower management into the core of human resources. Organizational members’ attitude or intentions particularly indicate the importance of employees’ organizational commitment. Dee et al. (2006) suggested that organizational commitment is a person’s intention to devote to and be loyal to the organization. Lambert et al. (2006) suggested that organizational commitment is the structural phenomenon of trading between individuals and organizations. It increases with time, but it does not lead to a transferable investment outcome. Thus, in theoretical study and practical use, scholars have valued organizational commitment in human resource management. In recent years, many scholars have probed into organizational commitment from the view of Porter et al. (1974). Thus, this study also followed the above view and divided organizational commitment into value commitment, effort commitment and retention commitment. This study further treated these three constructs as criteria to measure hospitality industry employees’ organizational commitment. Definitions of these constructs are thus shown: (1) Value commitment: a strong belief and identification with organizational goals and values. 2) Effort commitment: the intention to devote more to the organization. (3) Retention commitment: a strong intention to continue being part of the organization. Internal marketing Internal Marketing (IM) is the process of handling staff as internal customers and projects as internal products that satisfy the needs and desires of the customers and adhere to the company’s goals (Berry and Parasuraman, 1991). Rafiq and Ahmed (1993) suggest that internal marketing involves â€Å"a planned effort to overcome organizational resistance to change and to align, motivate Tsai et al. 4121 nd integrate employees towards the effective implementation of corporate and functional strategies†. Joseph (1996) suggested that internal marketing is can be applied to marketing and human resource management, combining theoretical techniques and principles in order to encourage, recruit and manage all employees in the organization and constantly improve external customer service and mutual services. In addition, Ahmed et al. (2003) defined internal marketing as the emp loyees’ evaluation of the reward system, internal communication, training and development of the company. Internal marketing empirical research in the service sector has proven that internal marketing has influenced on internal customers (that is, employees) satisfactions. Berry and Parasuraman (1991) suggested that the advantages of internal marketing implementation in organizations are as follows: (1) To acquire and keep excellent talent; (2) to provide a common vision so that employees have job purpose and meaning; (3) to give employees the ability and knowledge to accomplish the work; (4) to encourage employees to share the results of teamwork; (5) to create job designs be based on the findings of marketing studies. The aforementioned views reveal that corporate implementation of internal marketing allows employees to enhance service quality, which increases the production and profits of the companies. The implementation of internal marketing in the organizations results in an internal service culture, raises service consciousness and increases profits (Parasuraman et al. , 1985). Based on the views of these scholars, internal marketing is critical for organizations and influences external marketing to further enhance customer satisfaction. According to the these definitions and based on the views of Rafiq and Ahmed (1993) and Ahmed et al. (2003), this study treated employee evaluations of reward systems, internal communication, and training and development of companies as criterion for measuring internal marketing of the hospitality industry. Leadership Leadership refers the process of influencing the team to accomplish the goals (Robbins and Coulter, 2005). Leaders are key success factors of an organization (Bass, 1985; Daft, 2002). Skillful leaders recognize and use the interpersonal relationships of the team and strengthen the members’ loyalty and morale. Effective leaders must learn skills such as patiently sharing information, trusting others and recognizing the timing of interventions (Steckler and Fondas, 1995). In recent years, numerous scholars have tried to discuss leadership from new perspectives. New studies of leadership theory have particularly stressed the influences of demands between leaders and subordinates, the interaction of personality traits and situational factors on leadership (Bargal and Schmid, 1989). Corporate leaders must select a proper leadership according to their subordinates’ different demands for supervision, in order to enhance employee satisfaction and fulfill expected goals. Bass and Avolio (1997) divided leadership into transformational leadership and transactional leadership. In transformational leadership, subordinates trust, respect and are loyal to their leaders. Leaders can develop their subordinates’ potential and enhance their confidence by changing their values and beliefs in order to increase their organizational commitment, intention and motivation to create exceptional outcomes. Transformational leadership can be divided into ideal traits, ideal behavior, the encouragement of inspiration, and the stimulation of wisdom and individual care. In addition, transactional leadership means leaders and members remain in the process of negotiation and mutual benefit instead of a persistent one-purpose relationship. Social exchange theory is treated as the theoretical base. When subordinates act according to their leaders’ expectations, they will have returns with a specific value. Transactional leadership can be divided into contingent rewards, and active and passive exceptional management. Most quantitative studies on leadership have created questionnaires using the MLQ scale designed by Bass and Avolio (1997). The MLQ scale includes two constructs (transformational leadership and transactional leadership). This study also designed a leadership questionnaire for the hospitality industry according to the MLQ scale. Empowerment Empowerment signals a transition away from traditional development that confined people’s role to that of passive recipients, effectively rendering them dependent on handouts in the form of foreign aid (O’Gorman, 1995). Bowen and Lawler III (1992) define empowerment as sharing with frontline employees four organizational ingredients: (1) Information about the organization’s performance; (2) rewards based on the organization’s performance; (3) knowledge about contributing to organizational performance; (4) power to make decisions that influence organizational direction and performance. Murat and Thomas (2003) suggested that empowerment does not simply refer to telling employees that they are empowered, but aims to allow the employees to recognize what power has been authorized. Boudrias et al. (2004) suggested that in managerial circles, empowerment application includes two types: (1) Empowering the responsibility of decision-making to subordinates while emphasizing rich work environments 4122 Afr. J. Bus. Manage. and diverse authority, information, resources and support, and providing the opportunity to learn in order to improve performance; (2) psychological empowerment, which refers to employees’ experiences of empowerment that are inferred as a mediating variable of empowerment and expected results. According to Sherman (1996), empowerment acknowledges that employees have the power to change in order to encourage employees to increase their competency. Kanter (1993) suggested that empowerment can keep employees from feeling helpless. Organizations could thus reduce negative effects such as low morale. The most significant effect of empowerment is to enhance employees’ abilities and self-efficacy (Conger and Kanungo, 1988). Bowen and Lawler III (1992) suggested the advantages of empowerment for organizations below: (1) To rapidly respond to customer demands and questions; (2) a high degree of employees’ job satisfaction; (3) positive interactions with consumers; (4) employees with creative thoughts; (5) the creation of loyal customers. About the definition of psychological empowerment, Spreitzer (1995) defines this concept as the psychological state that employees must experience for managerial empowerment interventions to be successful.

Describe the Three Different Parenting Styles and Discuss How They Might Impact on Children’s Behavior

According to Diana Baumrind, a clinical and developmental psychologist, parents will use one of three parenting styles. Baumrind based these three parenting styles on four factors; Disciplinary strategies, Warmth and Nurturance, Communication styles and expectations of maturity and control, these were identified as the four dimensions of parenting. I will now discuss the three parenting styles and the impacts these styles have on children’s behaviour. Baumrind’s three parenting style’s, based on the four dimensions of parenting are; Authoritarian, Permissive and Authoritative. Authoritarian parents set very strict disciplinary rules; they expect their children to follow strict rules and regulations with strict boundaries. They exert their control over their children by telling them what they can and can’t do, without giving them choices or options. Authoritarian parents often scold and punish their children, often in a harsh manner, for not following their rules. Words and phrases an Authoritarian parent may use might include; â€Å"‘No you can’t †¦. ’, ‘Because I say so, that’s why’, ‘Do it, do it NOW! † (2013) According to Baumrind, these parents are â€Å"obedience and status orientated and expect their orders to be obeyed without explanation† (1991) Permissive parents make very few demands on their children and rarely discipline or punish them. They have low expectations of self-control and maturity and are often communicative and nurturing with their children, preferring to be more of a friend than a parent. Words and phrases a Permissive parent may use might include; â€Å"’It’s up to you. If that’s what you really want to do then †¦. ’’The reason for wanting you to †¦Ã¢â‚¬ ¦ is †¦Ã¢â‚¬ ¦. ’Well, if you don’t feel like it †¦.. ’† (2013) According to Baumrind, Permissive parents â€Å"are more responsive than they are demanding. They are non-traditional and lenient and do not require mature behaviour, they allow considerable self-regulation and avoid confrontation† (1991) Authoritative parenting style is very much like the Authoritarian parenting style in as much as they also like to establish rules and guidelines that their children are expected to follow, however, this style is much more lenient as these parents realise that sometim es flexibility is required. When children fail to meet expectations, the parents are nurturing and forgiving. Authoritative parents are responsive to their children and are willing to listen to and answer questions asked by the child / children. Words and phrases an Authoritative parent may use might include;†Ã¢â‚¬â„¢This is my view†¦.. but what are your thoughts? ’, ‘Sorry, but I thought we agreed †¦Ã¢â‚¬ ¦ ’† (2013) Baumrind suggests that these parents â€Å"monitor and impart clear standards for their children’s conduct. They are assertive, but not intrusive and restrictive. Their disciplinary methods are supportive rather than punitive. They want their children to be assertive as well as socially responsible and self-regulated as well as co-operative† (1991) Behaviour can be both good and bad, of the three parenting styles, the Authoritarian is the most ineffective as children will be obedient, but disrespectful, angry, mistrustful, defiant, withdrawn and rebellious (as they grow up) due to the strict rules and regulations set by the parents. Permissive parenting is deemed a very negligent style of parenting due to the lack of rules and boundaries, although impacts can be both negative and positive, children of permissive parents tend to be irresponsible, impulsive, immature, insecure, demanding, self-centred and will show a poor performance academically, but positive impacts are better social skills and belief in themselves. The Authoritative style has to be the best style of parenting as they exercise a balanced control over their children by setting clear standards, rules and guidelines with non-punitive punishment, whilst encouraging them to be independent individuals, they will listen to what the child has to say and is open to negotiation leading to happy, socially competent children who are independent and full of self-esteem. It is not only parenting styles that impact on children’s behaviour; other factors in a child’s life can also affect behaviour, i. e. negative or traumatic family incidents like bereavement, illness, abuse, cultural and religious beliefs, bullying and peer pressure to name but a few, for example; â€Å"Thomas found it hard to adjust to sharing his parents with Rowanna when she was first born† causing his behaviour to change dramatically. (Open University 2013, pg32) To conclude, I have shown that parenting styles vary considerably, have different impacts on children and behaviour and all have negative and positive effects and that it is not just parenting styles that impact on children’s behaviour, as children raised in dramatically different environments can later grow up to have remarkably similar personalities and also children who share a home and are raised in the same manner, can grow up to have dramatically different personalities. But of the three parenting style’s, the one deemed to be the best style of parenting is the Authoritative parenting style, as it is a well balanced style with warmth, support and acceptance. There is control over children but without being controlling. There are firm rules and guidelines set in place, but there is room for flexibility when needed leading to happy, socially competent, independent, confident high achieving children.

Do Women Enjoy Equal Right in Nepal Essay

Our country, Nepal is popularly known as a traditional nation. It gives more priority to its customs and traditions rather than other subjects of matter. This country has been ruled and operated by majority of men since the beginning of humanity. Men play the vital role in each sector of development. History of Nepal is the evidence that all the development works are carried out by majority of men and less women. Even though, there is equal importance of male and female in development of nation, females are kept aside in development as well as social matter. In each and every sector, men play a main role and women are in inferior position. The main cause of such vast differences is the lack of education and public awareness. Such differences start from the early period of males and females life. In point of view of Nepalese people, females are regarded as a curse and males as boon. They do not like bearing female baby as they have to get her married and provide dowry. So, they take it as burden. That’s why, when they bear a boy and a girl, they give higher priority and more love to boy and the girl is kept within the four walls of home. Thus, no matter how talented they are, they never get a chance to develop. The condition of women living in our country is really miserable. Women living in our society are still under the shadow of darkness. They are bounded by the traditional concept of conservative society. They are busy mostly in kitchen and household works. Though, women occupy more population in Nepal, they have less participation in the high level jobs and some other important matters related to their life. They can experience very few legal rights and even our society places them in an inferior position. This was often justified as being the result of biological differences between the sexes. Women were thought to be more emotional and less decisive than men. They are not given sufficient opportunities to improve themselves and are discouraged to go ahead. No matter whatever progress they make, they are still suppressed by this traditional society. Moreover, they are somehow  experiencing basic rights, but they are deprived of social rights in many ways. Furthermore, they are regarded as the symbol of creating, protecting and nursing. They bear and grow-up children. They have many more responsibilities like biological, social and national. But, still their condition in our nation is backward. They are so because of male domination, traditional, social structures, unequal laws, lack of awareness, poverty and lack of government protection for them. Women in our society have been confined only to household chores, rearing children, preparing food, collecting fodder for cattle and family sanitation. Especially, they do not have freedom for movement and for adopting job. They are deprived of higher studies and property rights. They are not encouraged for social exposure. Furthermore, they had been the victim of domestic violence from their husbands, brothers, mother-in-law and even relatives. Their appeal is not uprightly accepted even by the administrator. Sometimes, they are even beaten, kidnapped and killed. Hence, they are really living a sorrowful life. CBS (Central Bureau of Statistics) and the report of UNDP shows that women’s participation in developmental works of Nepal is of low grade. Their rate of involvement in different sectors like education, civil service, participation in teaching and legal practice is very low. Though many NGOs (National Government Organization), INGOs (International Government Organization) and governmental organizations are working for the rights of women, their condition has not been improved significantly. Therefore, in first place, the women themselves must raise voice for their rights. Government, stakeholders, NGOs and INGOs has to take certain measures to uplift the condition of women in every nook and cranny of Nepal. Awareness programs must be conducted in their favor. Rallies with slogans like â€Å"GENDER EQUALITY†, â€Å"EDUCATION FOR ALL†, and etcetera must be spread all over our country. Thus, women must be provided with rights equal to that of men. Covert Prestige - Essay Example This phenomenon, known as covert prestige, implies that the speaker or organization has a favorable affinity with the minority group that the slang is borrowed from (Savan 65). This gives the audience some instant familiarity with both groups and promotes their sense of fairness and individuality, even while exploiting the concept of race and using a mass marketing technique. However, this instant bonding may be an insult to the outgroup and embarrassing to the speaker. The bond formed by this appropriation of language is a shallow pandering to the fragile white need for acceptance by an out group, as well as having the potential to be insulting and demeaning to black people and their culture. America has witnessed an onslaught of products that have been promoted by loosely linking the product with the black culture through the use of black slang. These products run the gamut from individual promotion to political parties, and from underwear to news items. They are all advertisements used to promote a product or an audience. However, care must be taken when analyzing an advertisement as Savan points out that black talk has become "part and parcel of American talk" and is not easily separated or categorized (Savan 72). A recent promotion for a political segment on FOX News illustrates the multiple factors that need to be considered when using cross-cultural slang for promotion, and the difficulty in effectively implementing it. Figure 1 is a televised byline that was used to promote a FOX News segment that was meant to inform the public of Michelle Obama's impact on the presidential campaign. The byline referred to Ms. Obama as Figure 1 (Koppelman) "Obama's Baby Mama". The phrase is used among the black culture to indicate the unwed mother of someone's child. Used in the black environment it has the potential to be a term of endearment, but may also be an insult and does not stand up to cross-cultural translation. It is in the same class as the 'n' word. Assuming that Fox news would not be so egregious as to blatantly use racism in their broadcasts, it must be that Fox was trying to appropriate a black phrase in an effort to appear to be more black. This effort was not too far from the early 20th century vision of the misguided white men in blackface that used black language to entertain a white audience, and in doing so became a horror show (Savan 75). It was an attempt to show that they understood black culture without any true racial sensitivity. Savan seems to underestimate the potential for racial backlash and contends, "For the most part, that rented association is working" (69). Savan has failed to recognize the importance of cultural and soci al contextualization when evaluating an audience's response to black slang. The Ms. Obama characterization demonstrates the difficulty that advertisers face when trying to capitalize on 'covert prestige'. It’s one of the major issues dissatisfied customers had with the SLF. Frank should consider slowing this down, and perhaps placing new staff members in proper training programs administered by current staff to ensure smooth staff changes. Whilst flexibility and ease of advancement may make the employees happier, the customers will suffer from the constant interrupted changes. Calveta should maintain a degree of normalcy in the workplace, and make it harder to advance (could have positive affects on employees motivation). Another structural issue is the current staff organization. If Frank is worried about the loss of emphasis on his father’s ideals he must communicate this effectively with the staff. Discussion groups, incentive packages, and achievable goals should be established for all staff members, especially new ones, so that company culture is maintained and reinforced. If Calveta are to grow, they will need a larger amount of regional employees. This will most likely lead to the hiring of persons outside of the company. Calveta need not hire them right out of college though. They may obtain them from similar companies with similar values and ideals. As GSD is about to be taken over, perhaps the better staff members may wish to come to Calveta  instead of staying on with a new owner. To ensure continuation of company culture pointed questions in the interview and recruitment process pertaining to it should be asked. Since it is bound by the pervious case, and thus same decision will be made and equal punishment will be punished for those who loss the case bases on the past cases. Example like Balfour case  [1]  and Merrit case  [2]  , where the decision made in Merrit case is bound to the Balfour case. It can be used by lawyers as a reference to create certainty which allow them to advice their client for the probability of winning and losing a case by forecasting the predictable result of the case based on the binding result of the previous case. The predictable result and probability of losing a case allow the client to settle it with privately with peace. If the probability of winning a case is higher, it satisfy the client with higher confident. Example for Balfour case and Mer rit case, since there are similar case occurred in the past, the lawyer can actually based on the previous case advice Miss Merrit about the percentage of winning the case. Furthermore, using case law as a source of law enables the judgment of the case to be settling in short period because of the binding precedent which is much more efficient. Shorter period of settling a case will reduce the legal cost paid by the client. If there are similar case occurred in the past, we have to follow the first precedent although which may sometimes cause hardship. There is no flexibility to change the first precedent once it is created. Although the decision is bad, it is binding until it is overruled. Example of case Donoghue and Stevenson which the plaintiff unable to successfully sued the defendant if plaintiff did not make appeal to the House of Lord to overruled the decision. There are too many cases occurred in the past. It is bulky and complex for the lawyer to learn all the case law since there are too many cases occurred in the past. If similar case occurred, the lawyer has to analyze many factors that are different from the first precedent in order to overruled it and win in the case. The nature changes rapidly. We have understood that the judicial precedent is practical in nature. However, the rapid changes in the nature which are too difficult for the body of case law to grow quickly enough to meet the modern demands. If there are new points in case law and which have the potential to overrule the first precedent, the case must be brought to the court of appeal. There are a lot of procedures that have to be done before appealing and thus it cannot be change in the short term period. Laws dealing with pollution are often media-limited, pertain only to a single environmental medium, such as air, water, soil and control both emissions of pollutants into the medium, as well as liability for exceeding permitted emissions and responsibility for cleanup. The Tourism Act of 2009 the State declares tourism as an indispensable element of the national economy and an industry of national interest and importance, which must be harnessed as an engine of socio-economic growth and cultural affirmation to generate investment, foreign exchange and employment, and to continue to mold an enhanced sense of national pride for all Filipinos. CONCERNS AND CONFLICTS Mining has a very poor record in the Philippines as a result of the massive social and environmental problems it has caused historically. Some organizations reveal the Philippines to be among the worst countries in the world with regard to tailings dam failures whereby the surface impoundments containing the toxic waste from the mining process failed with disastrous consequences for local people and the environment. In spite of this the Government of the Philippines has been pursuing an aggressive policy to revitalize the mining industry, potentially opening 30 per cent of the countrys land area to mining. It has promised that mining will be carried out to full international standards and that environmental and social problems will be addressed effectively. The government has conducted mining road shows across the globe. Incentives for foreign firms make their operations effectively tax-free for the first five years. Billions of dollars in investments have been promised and a total o f 2,000 mining permit applications are pending. Mining is targeted for many upland areas where it would further reduce forest cover and leave a toxic heritage for succeeding generations. Natural hazards are common in the Philippines, with major portions of the country classified as natural disaster hotspots. Much of its mineral resources lie either in areas of rich biodiversity, in geo hazard zones or within the ancestral domain of indigenous peoples. Responsible mining, in accordance with international best practice, is simply not being observed in the country. Despite the legal frameworks and guidelines, in practice mining applications are considered for watershed areas. Mining is also pursued in conflict zones, the combination of inadequate protection measures and natural hazards can be and has been catastrophic. The countrys record of mining accidents is evidence of this. Most infamous is the Marcopper disaster of 1996, on Marinduque Island, when a mine tailings spill of more than four million metric tons of waste caused widespread flooding and damage to farm lands and property. Villages were evacuated and an estimated 20,000 people along the Boac River were affected. The river was subsequently declared biologically dead. More recently, following spills of cyanide and tailings at Rapu-Rapu Island the governments current mining showcase in Albay, Southern Luzon, an independent commission established by the Government found the company guilty of negligence and recommended that the mining operation be closed down. The government failed to do this and the mine remains open. Most of the Philippines mineral resources are located within the ancestral doma in of its indigenous peoples. Witnessed at first hand the havoc mining is wreaking on the livelihoods, health and human rights of indigenous peoples and other local communities. It also has the potential for massive environmental damage to critical water catchment areas, thousands of hectares of agricultural land and the valuable marine environment. Given the rapidly growing population, which is projected to rise from 84 million to 150 million by 2036, the destruction of these vital ecosystems will have serious implications for the food security and future sustainable development of the country. Unless the water catchment areas are protected and forests are replanted on a massive scale with native species, it is estimated that at least 50 per cent of sustainable agriculture, which require irrigation, will be lost. There are many vocal advocates for the rights of indigenous peoples, local communities and protection of the environment. The development of mining under current circumsta nces is understandably a major and controversial issue. There have been many legitimate expressions of concern and opposition. Even in Congress strong voices are calling for amendments to the mining law. Some people in government and in corporations, however, have labeled critics of these policies as anti-mining and leftist. In the context of the ongoing armed conflict in the Philippines between government and left-wing guerrilla forces, it is feared that such labeling is viewed by some in the military as an incitement to action. Hundreds of people labeled in this way, including many involved in peaceful and legitimate criticism of mining projects and policies, have been killed and targeted for execution. One human rights organization has recorded more than 70017 extra-judicial killings since 2001, with many human rights and environmental activists among the victims. For me we must consider very carefully the ways in which we can help other nations not to harm the environment. Richer nations can criticize the poorer ones for destroying their forests and ravaging their land, even though the more affluent nations contribute to that destruction. Existing international economic structures are such that nations in the third world are forced into using up their natural resources. My own conclusion from the visit was that I have never seen anything so systematically destructive as the mining programmed in the Philippines. Days after the situations bloody resolution, tempers are high in Hong Kong and China, Filipinos ponder how their government has failed them, and the world is asking if any foreign traveler is safe when visiting Manila or the Philippines. Its a fair question; Filipinos will be the first to acknowledge that their famously congested capital city is rife with crime, and local institutions are ill-equipped to handle the caseload. Despite the authorities concerted efforts, gan gs continue to prey on naÃÆ'Â ¯ve travelers, using deception or force to rob their victims or worse. Individual attacks against foreigners hit the news stream from time to time Peace Corps volunteer Julia Campbell was killed while hiking through Ifugao Province in 2007. Tellingly, the head of the Philippines Department of Justice blamed the victim, calling Campbell a little irresponsible for walking unescorted in the mountains. More recently, expats in Angeles City were targeted by a serial killer who coveted their expensive electronics; the suspect had originally been arrested once before, but was set free by the police for unknown reasons. These cases demonstrate a chilling fact tourists in the Philippines cannot expect the same support from the authorities that she might take for granted in places like Hong Kong or Singapore. Not only is the peace-and-order situation in the Philippines far more volatile than in more developed parts of Southeast Asia, the Philippine governments response to tourist safety situations has proven to be problematic, and not even the newly-elected government looks set to solve these problems anytime soon. It only indicates that our law enforcement agencies have few capabilities to handle situations like this, says Banlaoi, noting the incidents tremendous impact on the Philippines tourism industry and the countrys ability to attract foreign investment. This situation is particularly galling considering that the government is targeting tourism as a key growth area. Just as more Filipinos are staking their economic future on a growing influx of tourists, the hijacking incident is seen to dash any hopes of a resurgence of tourism in the Philippines. The Philippines Department of Tourism had earlier projected increased tourist arrivals of 15 percent for the year 2010, up from 8.9 million arrivals last year. The increased number still pales compared to Thailands fifteen million arrivals in the same time period only time will tell if the Department of Tourism will have to revise those figures downward. The DOTs optimism seems hard to sustain in the face of systemic weakness in the Philippines tourism infrastructure. Its not for lack of trying; investors poured $1.3 billion into the Philippine tourism industry between 2000 and 2009, creating 3 million tourism-related jobs in the process, or about 10% of total jobs in the Philippines. That means one in ten jobs in the Philippines will be affected by any tourism downturn caused by news of the hijacking. In the short term, visits have already been affected by the recent news. Thousands of canceled bookings have been reported from tour operators and hotels from all around the Philippines; Boracay operators may lose between P7 million to P10 million due to over 800 cancellations from wary Chinese tourists. On the other hand, other travel groups originating from China have adopted a wait-and-see attitude, quoting Asiatravel.coms David Boh as saying: Normally people will travel from October onwards, so it is still a month away. So what some of our guests are doing is waiting to see how the situation turns out. Some of the guests, what they do is that they purchase additional travel insurance.Pessimists in the local tourism industry worry that the Philippines, never a popular destination at any rate, will remain the purview of courageous backpackers, an even bigger tourism backwater than Laos. Lacking consistent support from the government, tour operators and professionals in the Philippines have taken it on themselves to do damage control in the wake of the hijacking. The Philippines attractions notwithstanding, visitors to the country must perform a delicate calculation, weighing the fun to be had in places like El Nido against the perceived negatives. Certain factors, more than others, will likely come into play. Lack of tourist infrastructure, despite the massive investment poured into tourist destinations, much of the infrastructure that tourists take for granted in other countries still doesnt exist in the Philippines. These include investments in infrastructure and human capacity, the development of comprehensive national strategies, the adoption of robust regulatory frameworks, mechanisms to maximize in-country foreign currency earnings, and efforts to reduce crime and corruption. Tourism is a thriving global industry with the power to shape developing countries in both positive and negative ways. The tourism sector has remained robust despite the transnational challenges posed by terrorism, health pandemics, and the global financial crisis. It is up to developing nations to seize the eco nomic opportunities that foreign visitors present, and some countries have proved more adept than others at doing so. Tourism can only achieve the above goals if it respects the environment and places host communities at the center of the development process. Responsibility lies with the governments of developing nations to ensure that tourism grows in a sustainable manner. While tourism can be a force for good both in alleviating poverty and helping to cement peace much depends on the way the sector is planned and managed. Tourism, if properly planned and managed, can help to alleviate poverty and stabilize communities. For that to happen, positive action must be taken by main constituencies host communities, host governments, and foreign stakeholders. Communities should know where their comparative advantage lies whether it is in wildlife, waterfalls, or wineries and focus their development strategy around it, rather than expanding into areas that they think will attract visitors but with which they are unfamiliar. Focus on keeping themselves at the center of their development strategy. This will ensure local ownership of projects and help to keep profits in house. Community-based tourism is also more sustainable and helps to provide the type of authentic experience that most tourists are looking for. Work on enhancing capacity, in both physical infrastructure and human capital. Protect the environment and culture. Communities should remember at all times that it is the beauty of the surroundings in w hich they live the richness of their culture, and the diversity of their wildlife that attracts visitors in the first place. A percentage of the wealth that tourism generates should be spent to preserve these qualities. Establish national tourism strategies and put in place robust laws to protect tourist sites and people who work in the tourist industry. They should also ensure that these laws are enforced. National standards should be established for the tourism industry and its employees should receive periodic training and guidance. Address bottlenecks and constraints. In many developing countries, tourism is undermined because no single government branch has overall responsibility for it. A government should ensure that its tourism sector is not undermined by competing or overlapping departments, at either the national or local levels. Have a creative marketing strategy for the tourist industry. The global tourism trade is highly competitive. Developing countries need to think a bout what sets them apart from other potential destinations and focus on marketing these distinctive qualities. Having a clear focus will also make it easier to attract foreign investment and visitors. Ecotourism could provide a blueprint for managing this process, as it not only builds entrepreneurial skills at a local level but also links community members to the larger world in ways that create knowledge, understanding, and appreciation of other peoples.

A Rose for Emily Essays -- A Rose For Emily, William Faulkner

Desperation for love arising from detachment can lead to extreme measures and destructive actions as exhibited by the tumultuous relationships of Miss Emily in William Faulkner's â€Å"A Rose for Emily† (rpt. in Thomas R. Arp and Greg Johnson, Perrine's Literature: Structure, Sound, and Sense, 9th ed. [Boston: Wadsworth, 2006] 556). Miss Emily is confined from society for the majority of her life by her father, so after he has died, she longs for relations that ironically her longing destroys. The despondency and obsession exuded throughout the story portray the predicament at hand. Miss Emily's relationship with her father is a key factor in the development of her isolation. As she is growing up, he will not let anybody around his daughter, particularly young suitors. The town assumes his decision is due to the idea that â€Å"the Griersons [hold] themselves a little too high for what they really [are]† to the point that â€Å"none of the young men [are] quite good enough† (559). Because Emily's father keeps her from everyone, she becomes very attached to him. He dies when she is nearly thirty, her only companion gone. Her strong bond to him is so severe that after his death, she denies he was dead at all and will not give his body up to the authorities for three days. The town observes that because she has â€Å"nothing left, she would have to cling to that which had robbed her,† meaning Emily is so desperate for a companion that when her father is gone, she has nothing left to cling to but him (559). However, he has a lasting effect on h er that contributes to her isolation. He instills the Grierson pride, so Daugherty 2 that she often does not interact with others. His influence is â€Å"too virulent and too furious to die† (562). Emily has a ... ...ther is concerned, he denies her the chance for love and detaches her from society. Partial blame can be placed on the attitude he instills in her so that she possesses the â€Å"dignity of the last Grierson† (560). She holds herself above others in the town, save Homer. The town's fickleness and disconnection towards her push her further into isolation. All of these factors finally result in the relationship with Homer. She is so desperate for contact and for love that when she finds them, she is terrified of their leaving. She is pushed then to kill Daugherty 4 Homer, so that love will never leave her again. Miss Emily is a desperate individual formed by the relationships that isolated her, which resulted in her extreme actions. Emily and Homer's short—yet long lived—relationship reveals a common effect of love denied and confinement from contact: destruction.
